The Right Attorney can Expunge a DUI

Florida DUI defense attorneys believe that a DUI conviction does not have to haunt you the rest of your life. An experienced drunk driving attorney can get a DUI expunged and give you a clean start.

Most people with a DUI are not "career criminals" but just someone who made a mistake, and probably did not realize how important hiring a good DUI lawyer was in the first place. Likely the DUI conviction is the only blot on their record, but still, it is a serious one that can impact everything from future employment to housing. But a DUI conviction maybe eligible to be expunged. When a record is expunged that means it is effectively sealed. In effect it is as if the DUI arrests or convictions never happened. Once your record has been expunged, you are no longer required to disclose it, not to a prospective employer or anyone else. Nor does anyone except in the case of very special circumstances have the right to request it. A good DUI defense attorney can make that a reality for you, and get back your good name by expunging your DUI record.

A Florida DUI attorney may be able to get your DUI expunged if you were arrested:

  • But no charges were filed
  • But the charges were then dropped;
  • And the charges were dismissed by the court
  • Charged with DUI, plead guilty, and received a withhold of adjudication
  • Charged with DUI, plead no contest (nolo contendere), and received a withhold of adjudication
  • Charged with DUI, found guilty by a jury, and received a withhold of adjudication.

Once a DUI attorney gets your DUI record expunged, it cannot be seen by the general public, potential employers, landlords or other such entities under any circumstances. However, the Florida Department of Law Enforcement (FDLE) is allowed to disclose the existence, but not the contents, of an expunged criminal record if you are applying for employment, certification or membership, with certain state and federal agencies.
